Organized Scheme to Defraud

Under Florida Statute 817.034, prosecutors must prove an ongoing, systematic course of conduct intended to obtain property through false representations. Penalties scale by the value alleged: under $20,000 is a third-degree felony, $20,000 to $50,000 is a second-degree felony, and $50,000 or more is a first-degree felony carrying up to 30 years in prison. When the scheme involves electronic communications, each email, call, or message can be charged as a separate count of communications fraud, dramatically increasing total exposure.

Aggravated White Collar Crime

Florida’s White Collar Crime Victim Protection Act creates an elevated classification when a scheme victimizes 10 or more elderly persons, 10 or more veterans, 20 or more individuals of any age, or involves $50,000 or more obtained from the state.
